This is the privacy policy of the website https://nl.gearshop.shimano.com/https://se.gearshop.shimano.com (“Site”) under control of the company incorporated under the laws of the Netherlands with its principal office at High Tech Campus 92, 5656 AG Eindhoven, The Netherlands, registered with the Chamber of Commerce under number 08076068 and trading under the name of Shimano (“We).

This Privacy Policy (“Policy”) is used to inform any person (a “You”) who is using the Site for information, ordering or returning of products or services of Shimano. This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from https://se.gearshop.shimano.com (the “Site”).

 

LEGAL BASIS

We will process your personal data obtained through the Site in accordance with applicable law, including the GDPR. When Shimano processes your personal data, this processing will be based on the purchase agreement between Shimano and You as described in the General Terms and this policy. Therefor the legal basis is contract.

We collect data when you visit the website as a potential customer to improve our marketing strategy, therefor the legal basis is legitimate interest.

If you sign up to become a Shimano member and receive newsletters and additional offers and information you give your consent for your membership and therefor the legal basis is consent.

 

PERSONAL INFORMATION WE COLLECT

When we explain the use of your “Personal Information” in this Privacy Policy, we sometimes split Order Information and Device Information, since these have different processes.

 

We collect certain information from you, including your name, billing address, shipping address, payment information (including , iDeal, Paypal, Mastercard, Visa, Klarna), email address, and phone number.

This personal data is requested to answer your questions and fulfill the order. If you do not share this information, no order can be placed via the Site.

We refer to this information as “Order Information.”

 

When you purchase goods via the Site or attempt to make a purchase through the Site, we send your details from our secure environment directly to Shopify. Shopify Payments will process our credit card payments and let us know if your payment was successful. We have no insight into your credit card details.

 

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

  • “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps
  • “location data” is used to give you the possibility to see the contact details of the nearest dealer /retailer for service purposes. You can block or switch off this service via your browser settings.

 

HOW DO WE USE YOUR PERSONAL INFORMATION? (purposes)

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we use this Order Information to:

  1. Communicate with you, to provide you with the requested products or services;
  2. Screen our orders for potential risk or fraud; and
  3. When in line with the preferences you have shared with us, provide you with additional information or advertising relating to our products or services, new features or new products or services related to the order that you placed such as newsletters and commercial messages.
  4. to ask you to participate in surveys and to manage the outcome of surveys in which you have participated;
  5. to organize joint marketing events with third parties;
  6. to satisfy statutory obligations of Shimano, such as obligations regarding bookkeeping and tax law;
  7. to improve your online experience on our websites;

If you do not want to receive information as stated under c. d. and e. you can opt-out during the application process and via the opt-out every email/survey;

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

 

DISCLOSURE TO THIRD PARTIES

We will not disclose your personal data to any third parties for commercial purposes; provided, however, Shimano reserves the right to use or disclose any information to a third party without your explicit consent in the following circumstances:

 

  1. If it is requested by any law or regulations, in order to comply with legal obligations we are subject to; to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights

If we deem it particularly necessary for cooperation with a governmental body or other public organization or its designee in discharging its duties pursuant to the law or regulations (including investigating breach of laws), or otherwise deems it particularly necessary for the performance of a task carried out in the public interest;
  3. If we outsource the handling of personal data to the extent necessary for its business operation, such as the transportation of ordered goods.
  4. We will use best efforts to inform you prior to such disclosure, including of the recipient of your personal data, by means of this privacy policy or, if appropriate, we will make efforts to inform you via other methods (e.g. email) when you are a registered contact.

 

We do share your Personal Information with third parties to help us use your Personal Information, as described above.

We use Klaviyo for emailmarketing, in each mail you receive a link to the privacy policy and an unsubscribe link;

We use third parties for logistic purposes, contact care platform, return process, payment process and reviews.

We also provide click and collect at a Shimano accredited dealer.

The Site uses public social media channels. We will never share your personal information on these channels without your prior consent. Whenever you respond to a message, giveaway or challenge on a social media channel you actively choose to share your profile name and avatar with us and the social media channel as well as it’s users.

Please note that we provide the same website when we see a Do Not Track signal from your browser.

 

YOUR RIGHTS

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above.  Additionally, please note that your information can be transferred outside of Europe, since Shimano is a global company.

You have the right to lodge a complaint about our processing of your personal data with the Dutch Data Protection Authority (Autoriteit persoonsgegevens) or the possible competent supervisory authority in your country.

You may invoke any of these rights by sending your request to: privacy@shimano-eu.com after which we will respond to your request within four weeks. Note that your all data that Shimano collects falls under the companies retention policy and will be deleted automatically after the default retention period. Via you account you can also opting-out for further data processing and receiving newsletters. This automated function will be the fastest way to have your data changed or removed.

We reserve the right to refuse any requests if your identity cannot be demonstrated by you and/or we can invoke any of the exceptions stated in the GDPR. In such case, we will inform you of the refusal.

We maintain state of the industry security measures to avoid unauthorized access to, alteration, disclosure or loss of your personal data. For example, we use Secure Sockets Layer (SSL) technology to encrypt important information, such as your order data, in an effort to prevent unauthorized access during transmission of your orders over the Internet. We implement standard industry practices internally and with our service providers to maintain the security of your personal data depending on its sensitivity and to avoid disclosure of such personal data unpermitted under this privacy policy.

We store data on in controlled environments. To maintain security, we conduct internal reviews of our security measures on a regular basis. Please note, however, that any personal data you post in chat rooms or message boards can be available to third parties that our out of control of Shimano. While we have taken commercially reasonable precautions to safeguard personal data, we cannot and do not guarantee complete security of personal data because complete security does not presently exist on the Internet.

 

DATA RETENTION

When you place an order through the Site, we will not store your personal data for a longer term than necessary for compliance with the storage terms provided for by law and the fulfilment of the purposes as mentioned in this Policy.

We will use the following guidelines for retaining the order data:

 

  1. The order data will be stored for 10 years, after which the order data will be destroyed.
  2. We will keep the name and email address as long as you have not chosen to opt-out from future newsletters, information and surveys.
  3. With third parties we use we make arrangements that never exceed the above retention periods

 

Data retention ensures that Shimano manages the data it controls and processes it in an efficient and responsible manner. When the retention period for the data as outlined above expires, Shimano will actively delete the data covered by this policy.

 

MINORS

The Site is not intended for individuals under the age of 6, the Site is a webshop that stimulate the sales of softgoods and thus implies payment obligations. We encourage parents to monitor their childrens behaviour online. Whenever softgoods are being purchased and paid via the webshop we assume that this is performed with adult permission.

  1. PARTIALLY AUTOMATED DESCISION MAKING

The site does not make any decisions that impact you as user, so there is no automated decision making here.

 

CHANGES

We will occasionally update this Policy as necessary to protect our users and to accommodate a changing environment. The changes to our Policy will be deemed to be effective from the date of posting on our Service unless we specify otherwise.
